<p>This information is relevant to all Buyers and Sellers of real estate.  These are five important issues to know or be familiar with prior to a closing.  Closers hear a lot of questions and comments about the transaction process at the closing table, but these are the most common issues that arise at this crucial time from both Buyers and Sellers. </p>
<p><strong>1. </strong> <strong>Know and understand tax proration.</strong>   It is very important to understand that Colorado property taxes are always paid in arrears, or after the year the property was assessed.  To calculate your tax proration, divide the total amount of taxes for the calendar year prior to closing by the number of days into the year of the closing date to get the tax amount per day.  That tax rate is then multiplied by the number of days from January 1 to the day of closing.  The resulting amount is then credited to the buyer.</p>
<p><strong>2. Review your HUD and Settlement Statements.  </strong>Be sure to review these documents with your agent before closing.  These forms itemize the services provided to you in buying/selling your home and how much each costs.  Such expenses include items connected with the loan, escrow account deposits, commissions, title charges, etc.</p>
<p><strong>3. Be prepared to bring certified funds and your ID.  </strong>Once you have reviewed your HUD and Settlement Statements prior to closing, you will now know if you owe any additional fees at the closing table.  Title companies will only accept certified funds, so a trip to the bank prior to the closing is necessary.  It is also important to bring your ID for proper identification to all parties. </p>
<p><strong>4. Sellers – be familiar with the tax documents.</strong> Sellers be aware of the tax documentation you will need to sign the 1083 &#8211; Information with Respect to a Conveyance of a Real Property Interest, the IRS form 1099 – used to report income, and to calculate the amount of taxes owed to the federal government, and finally, FIRPTA – Foreign Investment in Real Property Tax Act – a taxation law that imposes tax on foreign persons selling real property in the US.</p>
<p><strong>5. Buyers – know your loan terms.</strong>  Buyers know your loan terms before coming to the closing.  There should be no surprises from your lender and you should be aware of the charges and fees in your loan package.  Your closer will not be able to change these for you and will delay closing if items in the loan package needs to be changed.</p>
<p>If you follow these points and communicate well with both your agent and lender, your transaction is sure to close smoothly!</p>

<p><strong>Attention Real Estate Investors!!</strong> Is it possible that you are considering selling your investment  property  but want to actually stay in the real estate game and purchase another property, perhaps even a vacation home? Of course you know the tax implications that follow…there are not just one tax but there are three taxes to pay if you don’t do a Section 1031 Exchange…The Capital Gains tax is 15%, the State of Colorado is another 5%, and the Recapture of Depreciation is another tax that needs to be calculated. This could be a potential 30% blended rate of taxes! A 1031 Exchange is the deferral of capital gains taxes that could save you thousands of dollars. I always recommend you speak with your CPA or tax advisor and/or your attorney before determining if a 1031 Exchange is the right scenario for your real estate transaction.</p>
<p>I also want to define for you the term <strong>“Like-Kind Exchange”</strong> before I go on to share with you the 6 Rules of 1031 Exchanges. “Like-Kind” is somewhat of a misnomer. You do not have to reinvest in commercial real estate if that is what you are selling. The same applies with residential property or raw land for instance. The term “Like-Kind” really just refers to real estate in general so feel free to exchange the kiddie condo for the commercial strip mall or even the vacant lots for a single family rental home.</p>
<p>The <strong>“6 Rules of a 1031 Exchange”</strong> is a simple way to determine if the sale of your investment real estate qualifies and is in fact exchangeable.</p>
<p><strong>Rule #1 –What you sell and What you buy or Exchange into must be “Held for Investment” or “Used for Business” for usually 1 year and 1 day.</strong> The Internal Revenue Service tends to views this length of time as a long term capital investment vs. a short term capital investment which is why a Fix &amp; Flip generally does not qualify.</p>
<p><strong>Rule #2 – 45 Day ID Rule</strong> – The 1031 Exchange actually starts on the day of closing for the sale of the “Relinquished Property”. You have exactly 45 calendar days to identify in writing up to 3 potential “Replacement Properties”.</p>
<p><strong>Rule #3 – 180 Day Rule</strong> – You have exactly 180 calendar days from the date that you closed on the “Relinquished Property”, to close on and complete the purchase of your new “Replacement Property”.  This time line runs in conjunction with the 45 Day timeline for identification.</p>
<p><strong>Rule #4 – QI or “Qualified Intermediary” Requirement</strong>- The IRS mandates that you use a QI or Accommodator, and it cannot be your personal attorney or your accountant. The IRS also does not allow that you as the seller, touch the money in any way during the exchange.</p>
<p><strong>Rule #5 – Title Requirement</strong> – You must not change how you hold title prior to the exchange or after the exchange for at least 1 year and 1 day or you may invalidate it. This applies to both the OLD property that you are selling and the NEW property that you are buying.  There are some exceptions, such as disregarded entities.</p>
<p><strong>Rule #6 –</strong> <strong>Reinvestment Requirements or Equal-or-Up Rule</strong>-To have ZERO tax implications come tax time you must buy equal or greater,  AND you must reinvest all the cash. Keep in mind also that in order to accomplish this you may even buy more than one property.  If you do buy down then you will have to pay the tax on the difference and only that portion is taxable. The commonly used term for that is “boot”.  You could also elect to keep some of the cash and that portion would be taxable as well.</p>
<p>When determining which Qualified Intermediary or 1031 Exchange Company to use please make sure that the funds are never comingled and that the company that you choose can provide you the Safety and Security of your Exchange funds entirely.</p>

<p>Parker Colorado is a Southeast suburb of Denver, Colorado.  Parker has had its share of distressed properties (short sales,  bank-owned/REO&#8217;s, and government-owned/HUD&#8217;s) hitting the market over the past few years.</p>
<p>However, the number of <strong>bank owned and HUD homes</strong> in the <strong>Stonegate neighborhood in Parker, Colorado</strong> has been steadily decreasing over the past year.   Last year, in 2010, 9 homes sold in Stonegate that were either HUD&#8217;s or REO&#8217;s.  Six months ago 4 of these homes sold and within the past few months only 3 homes have sold*.   This could be attributed to normal seasonal changes in the market&#8230; traditionally speaking,  as the weather gets cooler, home sales decrease.</p>
<p><strong>These Stonegate REO homes and HUD&#8217;s are spending an average of 53 days on the market.</strong>  And these distressed Parker homes have been selling for an average price of $261,155.  As of today, (Nov 2011) there is one home on the market in Stonegate, which is bank owned, and with a list price of $355,000.  There are 4 REO&#8217;s in Parker&#8217;s Stonegate neighborhood that are under contract with an average asking price of $271,615.</p>
<p><strong>Short sale properties in Stonegate</strong> have fluctuated over the past year.  12 months ago there were six short sale homes sold in Stonegate.  Six months ago 2 homes in foreclosure sold and within the past 3 months three short sale properties in Stonegate have sold.</p>
<p>Compared to bank owned properties within the Stonegate neighborhood, the days spent on the market is significantly higher.  This is no surprise, of course, as the lenders are working through their inventory glut, and likely will be for some time.  However, the short sale process has improved somewhat as new lender reforms have been put in place by many of the major lending intuitions to hopefully prevent some of this &#8220;shadow inventory&#8221; phenomenon from occurring that we&#8217;ve been hearing so much about lately.</p>
<p><strong>The average sales price of these short sale homes in Parker&#8217;s Stonegate community has experienced significant increases</strong> during this past year going from $267,500 one year ago all the way up to $330,000 today.  This could be because there are fewer homes for sale throughout Denver Metro, or perhaps these homes were simply in better shape with nicer upgrades, cleaner, etc.</p>
<p>If you are interested in selling your home and thinking you may need to do a short sale, you&#8217;ll want to talk to a Realtor who is experienced with this distressed sale situation. There is competition in the marketplace so you&#8217;ll want to make sure your home is priced accordingly to attract offers that the bank is likely to accept.</p>

<p>Often times when you turn on the news you might be bombarded with negative messages about the economy as well as the housing market. This might lead you to ask yourself <strong>&#8220;how is the Denver housing market compare with the rest of the nation?&#8221;</strong></p>
<p>The answer is really quite simple. Denver’s real estate market conditions are TERRIFIC! Colorado started to experience the mortgage meltdown almost a year earlier than the rest of the nation. This was due in part because property values were some of the fastest to rise in the nation in the late 1990’s and early 2000’s. Colorado homes became some of the most over valued property around while having a large number of jobs being transferred out of the state. This combination helped Denver to find its &#8220;bottom&#8221; in the real estate market relatively fast compared to the rest of the nation.</p>
<p>Today, the Metro Denver real estate market is thriving.<strong> Denver&#8217;s real estate market &#8220;turned the corner&#8221;</strong> back in September of 2010 and has recognized a small uptake in property values across a majority of the Denver metro area. Most home owners are beginning to recognize that by selling their home now in this more stable market, they can still afford to buy the under-valued home of their dreams at a tremendous savings due to the historically low interest rates that we are seeing. This is allowing &#8220;move-up&#8221; home buyers to purchase a more expensive home, and in most cases, still have a lower mortgage than they had with their previous home.</p>
<p>First time home buyers are the real winners in this market. They can buy a starter home for a fraction of the price that it was valued at just five years ago. This also means that the first time home buyers will have the opportunity to recognize equity in their homes as the market continues to improve.</p>
<p>In short, don’t believe everything you see on television. Keep in mind that even though our nation might have a 9% unemployment rate, that is only 2% &#8211; 2.5% higher than normal. That also means that 91% of Americans DO have employment and that those 91% are still buying and selling real estate!</p>
<p>To summarize, the Denver real estate market is very active.  People who are able to take advantage of stable prices and low interest rates will benefit greatly as the market continues to improve.  NOW IS THE TIME TO BUY &amp; SELL WHILE INTEREST RATES ARE THIS LOW!</p>

A Home Warranty is a service agreement that offers cash flow protection for home owners. Home warranties protect against the often large costs associated with fixing and or replacing major systems and appliances when they break down due to normal wear and tear.  Some potential big home ownership expenses include plumbing, heating, cooling, electrical, dishwasher, oven, range, stove top, garbage disposal and trash compactor, just to name a few. Having a Home Warranty is a good companion to your homeowners insurance because it covers the things that homeowners insurance does not. Home warranties are also renewable year after year.</p>
<p><strong>So how does a Home Warranty work?</strong> When a home owner calls in a claim or claims to the home warranty company, the company contacts a technician they have contracted with to provide service. The technician will call the homeowner to set up a time to address the claim. At the time of service the home owner pays a very low deductible, of about $50-$60.  Fixing or replacing a major system or appliance, including labor and parts for only $50 or $60 is a great value. Many homeowners also like the fact that they make one phone call to the warranty company for help instead of searching for plumbers, electricians and appliance technicians.</p>

<p>Home sellers use home warranties as a powerful marketing tool, on average selling homes twenty three days faster. Even the National Association of Realtors recognizes the fact that homes sell faster when advertised with a home warranty.</p>
<p>Home warranties are not paid for until closing. How many marketing tools do you know of that you get to put to use right away and not pay for upfront? Wow!</p>
<p>When a home warranty is not offered by a seller smart buyers may ask for the seller to provide a home warranty as a part of the sale.</p>
<p><strong>How do I choose a home warranty company?  </strong><br />
When shopping for a good home warranty company, consider the length of time they have been in business, the strength of the company, and their Better Business Bureau rating.  Or ask your Realtor, friends or co-workers for recommendations on companies that they have personally used and had a great experience with!</p>

</em><strong>Should I test for radon in Colorado?</strong>  This is a common question asked at home inspections.   Radon is a  naturally occurring, odorless, colorless, radioactive gas that is formed by the ongoing decay of uranium in soil, rocks, sediments, and even well or ground water. Radon gas forms during the decay of uranium-238, and has a half-life of only 3.825 days.  Over the course of several days a radon atom becomes a lead atom. </p>
<p><strong>Where does Radon Come From? </strong><br />
Radon gas can migrate into your Colorado home in several ways. Openings or cracks in basement walls or floors are common avenues. Sump pits, basement drains, and spaces between gas or water fittings can also allow radon into the structure.  Radon is a very dense substance and remains a gas under normal conditions.  Since it does not dissipate well, it can follow water pipes to higher floors.  It is considered a health hazard due to its radioactivity. </p>
<p><strong>Health Risks of Radon<br />
</strong>While radon that escapes into the atmosphere is not harmful, dangerously high concentrations can build up indoors, exposing residents to possible health risks.  More and more Colorado homeowners (and soon-to-be homeowners) are considering radon detection a &#8220;must&#8221; &#8211; and with good reason.  Radon is considered a significant contaminant that affects indoor air quality. Studies have shown a clear link between breathing high concentrations of radon and the incidence of lung cancer. According to the EPA, radon is the second most frequent cause of lung cancer, after cigarette smoking, and is credited with approximately 350 deaths a year in the state of Colorado, yet it is easily preventable.  Over 80% of the state of Colorado is considered a red zone for radon.  </p>
<p><strong>Colorado Radon Testing Options</strong><br />
Radon testing can be done by a professional or homeowner using a &#8220;do-it-yourself&#8221; kit. It is important that either the professional service or home test kit be EPA-approved. A professional will be able to provide “instant” results, while a “Do it yourself” kit needs to be sent to a lab. Because radon levels can vary from day to day and from season to season, testing can be done on the short-term (two to 90 days) or long-term (greater than three months). Short-term tests are best done if the results are needed quickly and should be followed by another short-term test. Long-term tests will yield better information on a home&#8217;s average year-round radon levels. It is standard in Colorado to place radon test devices in the lowest occupied level of the home.</p>
<p><strong>Radon mitigation methods</strong> can include sealing likely entry points, improving ventilation, and a process called soil depressurization, which vents air from the house back into the surrounding soil, reducing the level of radon that can enter the home. Professional mitigation services are required to provide guidelines and recommendations for a home&#8217;s specific conditions.  Professional mitigation services can install vacuum fans according to EPA standards that will prevent further radon intrusion.</p>

</strong></span>The <strong>Centennial at Riverwalk</strong> is age restricted and open to residents who are <strong>55+</strong>. These age restricted condos range in size from about 665 square feet for a 1 bedroom/1 bathroom unit to 1321 square feet for a 2 bedroom/2 bathroom unit, and with a few other floor plans in between. All of the units in Riverwalk’s 55+ Centennial buildings are ranch style units. There is elevator access to the different floors and a parking garage under the building. Additional storage is a possibility in the parking garage, too. These building were designed with the 55+ resident in mind- no stairs, and no braving inclement weather to get to your car or to your mailbox! There is also a lovely sitting room upon entering the Centennial buildings where you can relax and read a book or meet with friends and family.</p>
